Terms of Service

Welcome to Gold Prospector. These Terms of Service ("Terms") govern your use of the Gold Prospector mobile application ("App") operated by Gold Prospector ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using Gold Prospector, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be legally bound by them. If you do not agree to these Terms, do not use the App.

2. Description of Service

Gold Prospector is a mobile application designed to assist recreational gold prospectors and metal detecting enthusiasts. The App provides tools including interactive mapping, gold find logging, AI-powered terrain analysis, an AI chatbot ("GoldBot"), trail tracking with optional background location, community features (posts, comments, direct messages, following), gamification (XP, badges, streaks), news aggregation, and educational guides.

The App is intended for informational and recreational purposes only. Gold Prospector does not constitute legal, surveying, geological, or professional mining advice.

3. User Accounts

3.1 You must create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3.2 You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.3 You may not create an account on behalf of another person without their explicit consent, or for the purpose of impersonating another person or entity.

3.4 We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. User-Generated Content

4.1 You retain ownership of all content you submit, post, or display through the App ("User Content"), including photos, posts, gold find records, and map pins.

4.2 By submitting User Content, you grant Gold Prospector a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and improving the App.

4.3 You represent and warrant that your User Content does not violate any third-party rights, including intellectual property rights and privacy rights, and does not contain unlawful, defamatory, harassing, or obscene material.

4.4 We reserve the right to remove any User Content that violates these Terms without notice.

5. Community Standards and Content Moderation

5.1 You agree not to use the App to:

5.2 The App uses automated content moderation systems to scan posts, comments, direct messages, and uploaded images. Content that is flagged as violating these Terms or our Community Guidelines may be blocked or removed without notice.

5.3 Users may report posts and comments that they believe violate these Terms. Reports are reviewed by our moderation team, and content that accumulates multiple reports may be temporarily hidden from public view pending review. Confirmed violations may result in content removal and account action against the reported user.

5.4 Repeated or severe violations may result in temporary suspension or permanent termination of your account at our sole discretion.

6. Maps, Location Data, and Legal Compliance

6.1 The App provides mapping tools, public land boundary overlays, and historic mine data for informational purposes only. This information may be incomplete, outdated, or inaccurate. Always verify land ownership and legal access independently before conducting any prospecting activity.

6.2 You are solely responsible for ensuring that your prospecting activities comply with all applicable federal, state, and local laws and regulations, including but not limited to laws governing mining claims, environmental protection, protected lands, water use, and trespass.

6.3 Gold Prospector does not authorize any activity on private land, protected areas, or land for which you do not have legal access. The App does not constitute a license or permit of any kind.

6.4 Location services within the App are used solely to provide you with map-based features and trail tracking. Your location data is not shared with third parties and is not used for advertising purposes.

6.5 The App offers an optional background location feature that records your trail even when the App is not actively in use. This feature is disabled by default and only runs when you explicitly enable it. You will see a clear in-app explanation before granting this permission, and you can revoke it at any time through your device's Settings.

7. AI Features

7.1 The App provides AI-powered features including terrain analysis ("AI Analysis") and a chatbot ("GoldBot"). These features are informational only and are not a guarantee of finding gold or any other outcome.

7.2 AI output may contain errors, omissions, outdated information, or hallucinated content. You are solely responsible for verifying any AI-generated suggestion before acting on it. AI cannot replace professional geological surveys, legal advice, or claim verification.

7.3 Photos and text you submit for AI Analysis or to GoldBot are processed by third-party AI providers (currently OpenAI) solely to generate the requested response. Submitted content is not used to train AI models and is not retained by the AI provider beyond the immediate response.

7.4 The AI Analysis score reflects geological factors visible in your photo and is not a measurement of actual gold present at the location. Always verify on-site, confirm public-land status, and check for active mining claims before prospecting.

8. Intellectual Property

8.1 The App, including its design, code, text, graphics, logos, and all other content created by Gold Prospector, is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted herein are reserved.

8.2 You may not copy, modify, distribute, sell, or lease any part of our App or its content without our prior written consent.

8.3 Third-party data displayed in the App, including USGS mine data, BLM land boundaries, Mapbox map tiles, and news articles, remains the property of their respective owners and is subject to their respective terms of use.

9. Subscription and Billing

9.1 Subscription Required. Gold Prospector requires an active subscription to access the App's features after a free trial period. We currently offer two subscription plans:

9.2 Free Trial. New users receive a 7-day free trial. You will not be charged during the trial period. The trial automatically converts to a paid subscription at the end of the 7 days unless you cancel before the trial ends.

9.3 Auto-Renewal. Your subscription automatically renews at the end of each billing period (monthly or annually) at the then-current price. To avoid being charged for the next period, you must turn off auto-renewal at least 24 hours before the end of the current period. Renewal charges are billed to your Apple ID account.

9.4 Managing Your Subscription. You can manage your subscription, change plans, or turn off auto-renewal at any time through your iPhone Settings → [your name] → Subscriptions, or through the App Store. We do not have direct access to modify or cancel your subscription on your behalf.

9.5 Refunds. All payments are processed by Apple and are subject to Apple's refund policies. To request a refund, you must submit a refund request directly to Apple at https://reportaproblem.apple.com. Gold Prospector cannot issue refunds directly.

9.6 Price Changes. We reserve the right to change subscription prices. If we change the price of a plan you are subscribed to, we will notify you in advance through the App and via Apple's required notice channels. Price changes only affect your subscription at the next renewal — your current billing period is not affected.

9.7 Cancellation. You may cancel your subscription at any time. After cancellation, you will continue to have access to subscription features until the end of your current billing period. We do not offer prorated refunds for partial billing periods.

9.8 What Happens to Your Data. If your subscription lapses, your account remains active and your data (gold finds, posts, photos, map pins, profile) is preserved. You can resubscribe at any time to regain access to subscription features.

10. Disclaimers and Limitation of Liability

10.1 THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Gold Prospector does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

10.3 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOLD PROSPECTOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.4 Gold Prospector is not responsible for any injury, loss, or damage of any kind resulting from prospecting activities undertaken based on information provided by the App. Prospecting involves inherent risks. Always exercise appropriate caution.

11. Indemnification

You agree to indemnify, defend, and hold harmless Gold Prospector and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App, your User Content, or your violation of these Terms.

12. Modifications to the App and Terms

12.1 We reserve the right to modify, suspend, or discontinue the App at any time without notice.

12.2 We may update these Terms from time to time. We will notify you of material changes by posting the new Terms within the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms.

13. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the App will immediately cease.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Shasta County, California.
